These Terms of Service ("Terms") govern your use of the website www.incomfortliving.com (the "Site") and services offered by InComfort Living ("we," "us," or "our"), a family-owned home services and property management company operated by Ryan and Sarah Stewart on Amelia Island, Florida. InComfort Living is insured and bonded and an affiliate member of AINCAR (Amelia Island Nassau County Association of Realtors). By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You may use our Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable local, state, or federal law
- Attempt to gain unauthorized access to any part of the Site, its servers, or any connected systems
- Use the Site to transmit unsolicited commercial communications (spam)
- Interfere with or disrupt the operation of the Site
- Scrape, reproduce, or redistribute Site content without our written permission
2. Services Overview
InComfort Living offers property management, home watch, cleaning, pet care, vendor coordination, arrival and departure services, home wellness checks, plant care, hurricane preparation, mail collection, and custom concierge services on Amelia Island and the surrounding Nassau County area. Our Site provides information about these services and allows you to request consultations and schedule services through our online booking system.
Service availability, scheduling, pricing, and specific terms are determined on a case-by-case basis and will be outlined in a separate service agreement between you and InComfort Living prior to any work being performed.
3. Service Agreements
These Terms govern your use of the Site only. Actual service engagements (property management, home watch, cleaning, etc.) are subject to separate written agreements that specify scope of work, pricing, scheduling, and other terms. In the event of any conflict between these Terms and a signed service agreement, the service agreement will prevail.
4. Consultation Requests
Submitting a consultation request through our Site does not create a binding contract or obligation on either party. We will make reasonable efforts to respond to all inquiries promptly, but submitting a request does not guarantee service availability.
5. Intellectual Property
All content on this Site — including text, graphics, logos, images, photographs, and design elements — is the property of InComfort Living or its content licensors and is protected by United States copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our prior written consent.
The InComfort Living name, logo, and tagline "The expertise of a manager, the trust of a neighbor" are trademarks of InComfort Living. Unauthorized use is prohibited.
6. Local Guides and Recommendations
Our Site features guides to local restaurants, activities, beaches, attractions, and service providers on Amelia Island. These recommendations are provided for informational purposes only and do not constitute endorsements. We make no guarantees regarding the quality, safety, or availability of any third-party businesses or services mentioned on our Site. Information may change without notice, and we recommend contacting businesses directly to confirm details.
7. Disclaimer of Warranties
The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the fullest extent permitted by law, InComfort Living, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including but not limited to loss of data, revenue, or profits, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from your use of the Site shall not exceed the amount you paid to us, if any, for accessing the Site during the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless InComfort Living, its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of your use of the Site or violation of these Terms.
10. Testimonials and User Content
Our Site may display testimonials from clients. Testimonials reflect the personal experiences of individual clients and are not intended to guarantee that all clients will have the same experience. We may edit testimonials for length or clarity, but not for substance. If you provide a testimonial, you grant InComfort Living a non-exclusive, royalty-free right to use your name, likeness, and testimonial on our Site and marketing materials.

InComfort Living maintains official accounts on Facebook, Instagram, and Twitter. Your interactions with us on these platforms are subject to the respective platform's terms of service and privacy policy in addition to these Terms.
